LIABILITY WAIVER ​

 

For your personal safety and for the comfort and safety of others, please

* Wear appropriate footwear for slippery and uneven terrain.

* Use sunscreen, especially when in exposed areas.

* Drink plenty of water - at least 2-3 liters per day.

* Watch your foot placement for potential trail hazards including but not limited to

snakes, bees nests, and skin-irritating plants.

* Perform a whole-body tick check at least once per day.

* Refrain from consuming alcohol.

* Be mindful of animals on the trails.

**ACCIDENT WAIVER FOR TRIPS AND ACTIVITIES**

**RELEASE OF LIABILITY**

(1) I acknowledge that the outdoor recreational activities, equipment, and

transportation associated with the described trip/outdoor activity to be conducted by Becca

Nenow Enterprises LLC DBA Woodsong, hereafter “Woodsong”, are outdoor sports activities

which may involve the risk of personal injuries or death; (2) I hereby agree for myself, all my

family members, heirs and any one accompanying me, to be effective to the greatest extent

permitted by law, to release Woodsong or any of its officers, directors, governors, members, trip

leaders, instructors, guides, drivers or agents from any and all liability claims, losses and/or

damages for personal injuries or death which may occur during participation in the above

named activity, any outdoor activity and transportation associated with said trip; (3) I hereby

agree for myself, all my family members, heirs and any one accompanying me, to be effective to

the greatest extent permitted by law, not to sue or make any negligence claims against

Woodsong or any of its officers, directors, governors, members, trip leaders, instructors, guides,

drivers or agents for personal injuries or wrongful death suffered as a result of participation in

the above named activities, related outdoor activity and transportation; (4) I intend this release

and agreement not to sue to be effective whether or not the injury or death results, in whole or in

part, from the negligence of Woodsong or any of its officers, directors, governors, members, trip

leaders, instructors, guides, drivers or agents; (5) I understand that negligence means failure to

do an act which a reasonably careful person would do, or the doing of an act which a

reasonably careful person would not do, under the same circumstances, to protect another from

injury or death; (6) I agree to be solely responsible for my own safety and well-being while

participating in the outdoor activities and transportation of Woodsong; (7) I agree that my vehicle

is parked and used at my own risk and will not holdWoodsong or any of its officers, directors,

governors, members, trip leaders, instructors, guides, drivers or agents responsible for any

damage or theft of or to said vehicle; (8) I agree to Woodsong commercial, journalistic and internal use of any media image, audio or visual, taken by, on behalf of, or for the use of Woodsong during my participation in any related activity; (9) I acknowledge that I may receive notifications via text, email, phone call or social media from Woodsong that may be related to the above activity or future planned activities; (10) I knowingly assume all risks associated with the activity and transportation, which include but are not limited to, the risk of personal injuries or death, which may occur during participation in the above named activity transportation and the activity associated with said emergency assistance. (12) I agree not to hold Woodsong responsible for any physical or bodily damage to any equipment or person(s) I use during the

named activities, which includes use of personal equipment and will assume all liability and

responsibility if that should occur.
